Terms of Service

1. Acceptance and role of the platform

By creating an account, posting listings, or otherwise using our marketplace, you agree to these Terms of Service and, where applicable, our Privacy Policy and Code of Conduct.

Wingman is an online platform that connects buyers and sellers. We are not a party to the purchase or sale between users: the sales contract is between those users, unless expressly stated otherwise.

2. Account and age

You must provide accurate registration details and keep your account credentials confidential. You are responsible for activity under your account unless you promptly notify us of unauthorised use.

You must be old enough to enter into binding contracts in your jurisdiction. Minors may need consent from a legal guardian where the law requires.

3. Listings and user content

You are responsible for the listings, photos, descriptions, and messages you post. You represent that you have the necessary rights and that your content does not infringe third-party rights.

You grant Wingman a non-exclusive licence to host, display, and technically process your content as needed to operate the platform.

4. Prohibited conduct and items

You must not misuse the platform. The following are non-exhaustive examples of prohibited behaviour:

• Offering illegal goods or services, or items that violate our Code of Conduct or applicable law.
• Misleading prices or descriptions, stolen goods, spam, or fraud.
• Harassing, threatening, discriminating against, or abusing other users.
• Circumventing technical security or features, or scraping without our written consent.
• Impersonating another person or entity.

5. Transactions, pricing, and disputes

Prices, delivery terms, warranties, and payment methods are agreed between seller and buyer, as permitted by law. We are not obliged to mediate disputes but may offer tools or guidance.

Risks relating to payment, shipping, quality, and performance lie between users. Take care when meeting strangers or paying people you do not know.

6. Paid features and subscriptions

Some features (such as promotions or subscriptions) may require payment. Amounts, duration, and cancellation terms are stated at purchase. Non-payment may lead to suspension of services.

7. Reviews and reputation

Reviews should be fair and relevant. Fake or malicious reviews are prohibited. We may remove or restrict reviews that breach our rules or the law.

8. Intellectual property

The platform, branding, design, and software are protected by intellectual property rights. You may not copy or commercially exploit them without prior consent.

9. Suspension and termination

We may suspend or terminate your account or access (temporarily or permanently) if you breach these terms, pose a risk to others or the platform, or where required by law. You may also close your account following instructions on the platform.

10. Availability and changes

We aim for a reliable service but do not guarantee uninterrupted availability. Maintenance, outages, or force majeure may cause disruption.

We may change or discontinue functionality. We may change these terms; for material changes we will make reasonable efforts to inform you.

11. Liability

To the extent permitted by applicable law for consumers, we are not liable for indirect damage, lost profits, or consequential loss. Our total liability to you for events in any twelve-month period is, where allowed, limited to the amount you paid us for the relevant paid service in that year, or otherwise to one hundred euros (€100).

Nothing in these terms limits liability that cannot legally be excluded.

12. Indemnity

You indemnify Wingman and its staff against third-party claims arising from your use of the platform, your listings, or your breach of these terms or others’ rights.

13. Governing law and disputes

These terms are subject to applicable law as determined by the business’s jurisdiction and mandatory consumer law where you live.
